At Arcade Express SL, we act as an authorized distributor of manufacturers who guarantee that the products offered in our online store www.arcadexpress.com are functional, safe, and free from defects or hidden flaws that could make them unsuitable for normal use.
Warranty Duration
The legal warranty offered to consumers and individuals is 3 years from the date of receipt of the order, as established by current legislation.
In the case of orders placed by companies or self-employed individuals (with an invoice issued to a commercial NIF/CIF), the Legal Warranty Law for the Sale of Consumer Goods will not apply, pursuant to Article 3.1 of Royal Legislative Decree 1/2007, as the client is not considered a consumer.
Important note: No client may request a warranty longer than the one indicated.
Warranty Exclusions
The warranty will not apply in the following cases:
- Apparent defects or visible damage not reported within 2 calendar days of delivery.
- Damage or deterioration caused by:
- Improper use or incorrect installation.
- Electrical accidents.
- External factors (impacts, falls, humidity, improper handling).
- Natural wear and tear from use.
- Products modified or repaired by the client or by unauthorized third parties.
- Aesthetic differences or minor variations compared to the images shown on the website, provided the characteristics and functionalities are equivalent to those described.
Warranty for Remanufactured or Second-Hand Products
In accordance with current legislation, all second-hand products sold by Arcade Express SL are covered by a 1-year legal warranty from the date of delivery. This warranty only covers malfunctions not derived from misuse, normal wear, or incorrect handling of the product.
In the event of a defect covered by the warranty, the customer may choose between repairing or replacing the product, unless one of these options is objectively impossible or disproportionate. If neither option is viable, a price reduction or contract termination will be offered.
The warranty excludes:
- Damage caused by improper or negligent use.
- Modifications or repairs carried out by the customer or unauthorized third parties.
- Components subject to usual wear due to use (such as buttons, cables, connectors, etc.).
Instructions for Use and Maintenance
Products include user and maintenance instructions provided by the manufacturer, either inside the packaging or on the product page on the website.
It is the customer’s responsibility to follow these instructions to maintain the warranty.
Warranty Management at Arcade Express SL
In the event of a defect or non-conformity of the product within the warranty period:
- Arcade Express SL will cover the shipping costs for the customer to return the product, provided the defect is attributable to the product.
- In cases where the manufacturer handles the warranty directly or covers shipping costs, Arcade Express SL will inform the customer how to proceed to manage the refund or collection.
Return and Reshipping Costs
- If after inspecting the returned product it is confirmed that there is no defect or that the defect was caused by customer misuse, Arcade Express SL will return the product to the customer with shipping costs due (after prior notice and cost confirmation).
- If the customer refuses to accept the return of a product without a valid reason attributable to Arcade Express SL, the company reserves the right to deduct all incurred shipping and handling costs from the total amount to be refunded.
Applicable Legislation
This warranty policy is governed by current Spanish and European legislation on consumer and user protection:
- Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws.
- Law 7/1996, of January 15, on the Regulation of Retail Trade.
- Directive 1999/44/EC of the European Parliament and of the Council of May 25, 1999, on certain aspects of the sale of consumer goods and associated guarantees.
- Directive (EU) 2019/771 of the European Parliament and of the Council of May 20, 2019, on certain aspects of contracts for the sale of goods.
